快猫视频 Group Guidelines on Respecting the Human Rights of Indigenous Peoples

We, the SMM Group (快猫视频. and its subsidiaries; hereinafter referred to as the "Group"), support the UN Guiding Principles on Business and Human Rights and promote initiatives to respect human rights in accordance with the 快猫视频 Group Policy on Human Rights (hereinafter referred to as the "Policy on Human Rights").

Because mine development, smelting and refining have a considerable effect on the environment and local communities, there is a risk of infringing on the rights of Indigenous Peoples who live on the land and are generally in vulnerable situations. Our Group therefore considers it a fundamental prerequisite to conduct its business while gaining the understanding and trust of Indigenous Peoples.

In accordance with the Policy on Human Rights, our Group respects the rights of Indigenous Peoples to the full enjoyment of human rights and fundamental freedoms, based on international norms and standards such as the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) and the International Council on Mining and Metals (ICMM) Mining Principles (hereinafter referred to as the "ICMM Mining Principles").

In conducting business activities around the world, the Group engages security companies to safeguard the security of its operations. The Group recognizes that security services may generally cause human rights violations through the misuse of force. In engaging security companies, the Group will refer to international norms and comply with the laws and regulations of the countries and regions concerned.

Further, in accordance with the ICMM Indigenous Peoples and Mining Position Statement (hereinafter referred to as the "ICMM Position Statement"), our Group recognizes our responsibility to respect the human rights of Indigenous Peoples and to carry out human rights due diligence. Through this, our Group will avoid infringing on the rights of Indigenous Peoples and will seek to obtain the consent of Indigenous Peoples who are anticipated to be affected. Furthermore, in accordance with the ICMM Position Statement, our Group intends to obtain the consent of Indigenous Peoples whose rights are impacted by our Group's activities, while recognizing that there may be circumstances in which consent is not obtained.

Based on this intention and recognition, and in order to respect the human rights of Indigenous Peoples, our Group sets out the following nine commitments, in addition to the commitments under the ICMM Mining Principles (in particular, Principle 3, Human Rights: "Respect human rights and the interests, cultures, customs and values of workers, communities, and other vulnerable groups – such as human rights defenders – who may be affected by our activities.").

  1. Respect Indigenous Peoples' rights by embedding measures across governance and management processes, including the Sustainability Committee chaired by the President of 快猫视频., its Board of Directors, and others, to avoid infringing Indigenous Peoples' rights and to adequately address potential adverse impacts to rights from mining and mining-related projects.
  2. Carry out human rights due diligence to identify, prevent, mitigate and account for potential adverse impacts on Indigenous Peoples' rights.
  3. Consult with potentially affected Indigenous Peoples and relevant State authorities, and seek agreement on appropriate engagement processes, as early as possible in project planning.
  4. In accordance with the principles of free, prior and informed consent (FPIC), obtain, as a basic principle, the consent of affected Indigenous Peoples to anticipated impacts on their land or other rights, and seek to reach agreement on the terms by which those impacts may occur and be managed.
  5. Address differences of opinion that arise and work to resolve disagreements.
  6. Strive to enable benefit sharing that reflects and is aligned with Indigenous Peoples' aspirations for social and economic development.
  7. Respect and incorporate Indigenous knowledge in collaboration with Indigenous Peoples through the design and implementation of human rights due diligence and methods of engagement, and likewise in agreements for benefit sharing, sustainable environmental and social investment programs, and closure planning and execution.
  8. Respect and celebrate cultural heritage, both tangible and intangible, and the historical and ongoing spiritual connections of Indigenous Peoples to such heritage. In particular, strive to prioritize the avoidance of impacts on cultural heritage that is critical to Indigenous Peoples' cultures or spiritual life.
  9. Provide, or cooperate in, remediation where the Group's activities are found to have caused or contributed to infringement of the rights of Indigenous Peoples. To this end, our Group will establish or participate in, and make available, effective grievance mechanisms that are free from conflicts of interest and do not subject complainants to detrimental treatment. In addition, as one of its independent grievance mechanisms, our Group will make available the contact for reporting grievances of the Engagement and Remedy Platform operated by the Japan Center for Engagement and Remedy on Business and Human Rights (JaCER).

These Guidelines were formulated with the assistance of human rights experts, discussed within the Sustainability Committee of 快猫视频., and approved by the Board of Directors.
